Terms of Service for the sale of Goods and Services at the Jagiellonian University Museum, the Nature Education Centre and the Botanical Garden

 

General provisions

Article 1

 

1. The Terms of Service for the sale of Goods and Services at the Jagiellonian University Museum, the JU Nature Education Centre and the Botanical Garden regulate the following rules:

    1) reservation and sale of Goods and Services at points of sale at the JU Museum, the Nature Education Centre and the Botanical Garden;

    2) sale of Services at ticket vending machines located within the facilities of the JU Museum, the Nature Education Centre and the Botanical Garden;

    3) sale of Goods and Services via the online sale system accessible at the following online address: https://bilety.uj.edu.pl

    4) enabling the customers to purchase goods and sales for reduced prices based on reduced and dedicated tickets received from the online ticket sale system;

    5) withdrawal from the distance agreement made between the Jagiellonian University and the customer;

    6) filling and processing agreements;

    7) processing the personal data of customers/users for the purposes defined in Article 12 of these Terms of Service.

 

2. The Terms of Service are available on the Online Sales Service on the following website: https://bilety.uj.edu.pl/index/regulamin-sprzedazy-biletow.html. The customer can print the full text and use it without online access, or receive the print version at any point of sale in the aforementioned establishments of the Jagiellonian University.

3. If the customer using the Online Sales Service is redirected to a website that is not operated by Jagiellonian University, hereinafter referred to as the "Website", then, to the extent that the customer uses another website, the terms and conditions for the online provision of services shall be determined by that Website.

4. The activities related to the online sale of goods and the online provision of services specified in these Regulations are performed by: JU Museum, the Nature Education Centre and the Botanical Garden.

5. The JU Facilities referred to in paragraph 4 may be contacted in the following manner:

6. The Jagiellonian University shall make the following functionalities available online:

    1) enabling browsing of the publicly available content of the Online Sales Service, including the content of the online shop;

    2) making it possible to conclude a distance agreement with Jagiellonian University on the terms and in the manner specified in these Terms of Service;

    3) maintaining a Customer Account created by the Customer as a result of voluntary registration in the Online Sales Service;

    4) sending a Newsletter to customers who have previously agreed to receive the requested commercial information within the meaning of Article 2(2) of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2020, item 344, as amended).

 

7. The condition for the use of the functionalities set out in paragraph 6 is the acceptance of the Terms of Service, which is tantamount to the conclusion of an agreement for the provision of services by electronic means under the terms and conditions set out in these Terms of Service for the free and voluntary use of the Online Sales Service by the customer.

8. The functionalities of the Online Sales Service referred to in paragraph 6 shall be provided free of charge, with the exception of the charge resulting from the sales agreement. The service agreement referred to in paragraph 7 shall be concluded for a fixed period of time, i.e. in the case of the functionality referred to in:

    1) Paragraph 6(1) — for a limited period of time, corresponding to viewing the content of the Online Sales Service; the Customer may terminate use of the Online Sales Service at any time;

    2) Paragraph 6(2) — for a limited period of time corresponding to the duration of the distance agreement process; the Customer may terminate the use of the Online Sales Service at any time;

    3) Paragraph 6 (3) — for a limited period of time, i.e. until the Customer requests the discontinuation of the Customer's Account; the Customer may terminate the use of the Online Sales Service at any time;

    4) Paragraph 6(4) - for a limited period of time, i.e. until the Customer requests the discontinuation of the previously ordered Newsletter; the Customer may terminate use of the Internet sales system at any time.

 

Article

Definitions of terms

 The terms used in the Terms of service are defined as follows:

     1) E-mail address — the address of the User's/Customer's active e-mail account, provided during the booking and sales process via the Online Sales Service under the terms and conditions set out in these Terms of Service, which enables and serves to keep the Facilities in constant contact  with the User/Customer;

     2) Ticket — a document entitling to use the current offer of a facility as defined in the Sales Price List attached to the Terms of Service;

     3) Sales Price List — the sales price list included in Appendix 1 to these Terms of Service;

     4) Business Day — a day of the week from Monday to Friday, excluding public holidays within the meaning of Article 1 and Article l(a) of the Law of 18 January 1951 on Public Holidays (Journal of Laws of 2020, item 1920, as amended);

     5) Proof of Purchase — a document other than an invoice, fiscal receipt or non-fiscal receipt, substantiating the purchase of a given good or service offered by the University;

     6) Exhibition (tour route) - a dedicated space enabling the presentation of collections;

     7) Form of Payment — a method of payment by the Customer for the purchased goods or services, consisting in particular of payment by electronic transfer or through an electronic payment system accepted by the University;

     8) Online Sales Service — an online sales service operated by the University and available to Customers, enabling them to place orders and conclude agreements at a distance, in particular to purchase tickets, Goods and Services; the service is available at: https://bilety.uj.edu.pl. The Online Sales Service provides content and functionalities allowing to browse available products, place orders, manage and realise them;

     9) Facility — the Jagiellonian University Museum, the JU Natural History Education Centre, and the Botanical Garden;

    10) Customer — a natural person with full legal capacity, and in cases provided for by generally applicable law, also a natural person with limited legal capacity, as well as a legal person and an organisational unit without legal personality to which special regulations grant legal capacity, and who intends to conclude or has already concluded an agreement for the online provision of services or a sales agreement with the University;

    11) Consumer — a natural person making a legal transaction with the University which is not directly related to their economic or professional activity, or a natural person concluding an agreement with the University which is directly related to their economic activity, if the content of the agreement indicates that it is not of a professional nature for that person, resulting in particular from the subject of their economic activity, made available on the basis of the regulations on the Central Register and Information on Economic Activity;

    12) Customer Account — a functionality offered by the Online Sales Service provided by the University on behalf of the Customer after registration and conclusion of an agreement for online provision of services which allows to maintain a Customer Account, the use of the shop, in particular the Shopping Cart, collecting data on the history of orders and the Customer's preferences as to the form of payment within a panel individual for a given Customer with secured access via login/email and password;

    13) Shopping Cart — a functionality of the Online Sales Service allowing the Customer to view the products selected for purchase, their quantity and value, allowing the Customer to place an order and consequently conclude a sales agreement;

    14) Museum Class — specialised thematic classes which can be accessed and attended by a single participant on the basis of an educational ticket, and in the case of the JUCentre for Nature Education — an educational ticket and a ticket for educational services;

    15) Online Museum Class — specialised thematic classes conducted by an educator via instant messaging which can be accessed and attended by a single participant on the basis of an educational ticket;

    16) Newsletter — an online service provided by the University via email which enables all Customers using it to automatically receive from the University the cyclical content of successive editions of the Newsletter, containing information about services and goods, news and special offers in the Online Sales Service;

    17) Entrepreneur — a natural person, a legal person and an organisational unit which is not a legal person and to which a separate act grants legal capacity, using the current offer of a given Facility within the framework of their own business or professional activity;

    18) Terms of Service — these Terms of Service together with the appendices, informing about the obligations, rules of use and rights of the two parties to the Agreement, available at: https://bilety.uj.edu.pl/index/regulamin-sprzedazy-biletow.html;

    19) Registration — creation of a Customer account in the Online Sales Service;

    20) Goods — tangible items offered to the Customer by a given Facility via the Online Sales Service;

    21) Agreement — a agreement concluded remotely on the basis of the provisions of these Terms of Service between the University and the Customer, the subject of which are the Goods indicated by the Customer in the Shopping Cart, in respect of which the University undertakes to transfer their ownership to the Customer and deliver them to the Customer, and the Customer undertakes to pay the price and collect the Goods;

    22) Jagiellonian University, ul. 24 Gołębia, 31-007 Kraków, Tax Identification Number (NIP) 675-000-22-36, Business Identification Number (REGON) 000001270, which sells Goods and Services offered by the Facilities;

    23) User — any Customer using the Online Sales Service;

    24) Service — an intangible service offered by a Facility to a Customer at a ticket office, ticket machine or via the Online Sales Service, in particular an admission service to an exhibition with or without a guided tour, a guide service, a service consisting of conducting a museum lesson in a stationary or remote (online) mode, a service of a personal or product photo session, admission to an Event;

    25) Voucher — a document entitling to use a specific Service obtained after paying at the Facility cash desk a fee equivalent to or a multiple of the price of the Service included in the price list of the Unit, which can be redeemed only at the Unit cash desk where it has been purchased;

    26) Event — any event of an educational, cultural, entertainment or sporting nature organised by the Facility, in particular a concert, performance, etc.

 

Article 3

Admission tickets and event tickets

 

1. Admission to and use of the Facility's offer is based on the entrance ticket or ticket for the Event.

2. The following types of tickets are available to Customers:

     1) normal ticket — entitling to entry of one person who is not entitled to any concessions defined by the Terms of Service, as specified in Article 4(1);

     2) reduced ticket —entitling to entry of one person who entitled to concessions defined by the Terms of Service, as specified in Article 4(1)

     3) dedicated ticket —entitling to entry within a specified time defined by each Facility in separate visiting rules;

     4) seasonal ticket — entitling to entry within a specified time defined by each Facility in separate visiting rules;

     5) annual ticket —entitling to multiple entries within 12 months after the date of purchase;

     6) annual ticket for seniors —entitling persons at the age over 65 to multiple entries within 12 months after the date of purchase;

     7) family ticket —entitling to entry of a parent (parents) or legal guardian (legal guardians) with a child (children) younger than 16;

     8) educational title — entitling to participate in organised museum classes as defined in Article 2(13) or (14);

     9) personal photo shoot ticket — entitling to realise an hour-long photo shoot of private nature, e.g. a wedding or family photo shoot;

    10) productional photo shoot ticket — entitling to realise an hour-long photo shoot of private nature, e.g. a fashion shoot for the purpose of product advertisement;

    11) guide service ticket —a one-time ticket entitling a group or a single to guide service;

    12) Educational service ticket — a one-time ticket entitling a group of a single person to participate in museum classes;

    13) packet ticket — a ticket entitling organised school groups to use selected services provided by the Facility, purchased only at a cash desk;

    14) combined ticket — an admission ticket entitling one person to choose from the offer provided by the three faculties, purchased only in the Online Sales Service;

    15) event ticket — a special type of ticket entitling one person to enter an Event.

 

3. The admission tickets listed in Article 2(1-14) entitle the holder to enter the exhibition within the Facility, and depending on the type of ticket chosen by the Customer in the sales process, entitle the holder to visit the respective Exhibition with or without guide service.

4. The Event ticket referred to in Article 2(15) is categorised depending on the individual Event by being assigned or not assigned to a particular sector designated in terms of the location of the seats to the stage or other centre of the Event.

5. The University reserves that the Facility may impose a limit on the number of admission and event tickets.

6. Reservation and sale of admission and event tickets is possible:

      1) at any ticket counter of the Facility;

      2) in the Online Sales System;

      3) through ticket vending machines set up in the Facility's premises.

7. The prices of admission and event tickets:

       1) are given in Polish Złoty (PLN);

       2) include value added tax (VAT) at the rate applicable as at the date of their sale;

       3) are displayed in the Online Sales Service in the interface of the ticket vending machine and are binding at the moment of the User's purchase of the ticket, in accordance with the Price List.

8. A Customer purchasing an admission or event ticket at the cash desk of the respective Faculty receives:

        1) a printed a printed admission or event ticket;

        2) a fiscal receipt or an invoice in accordance with the rules set out in Article 3(10) of the Terms of Service, with the reservation that an Entrepreneur who is a VAT or value added tax payer may receive an invoice if the previously received receipt confirming the purchase of the ticket includes the Tax Identification Number (NIP) with which the Entrepreneur is identified for the purposes of VAT or value added tax.

9. A customer purchasing an admission or event ticket in the Online Sales Service receives:

        1) a pro forma invoice saved as a PDF file;

        2)the admission or event ticket;

        3) a non-fiscal receipt or an invoice upon request made during the purchase of a ticket via the Internet sales system or a subsequent request made in accordance with Paragraph 10, together with the presentation of the received admission ticket, ticket for the Event or the received proof of purchase at a stationary cash desk of the Facility no later than within 3 months, counting from the end of the month in which the ticket was purchased.

10. The request for an invoice for early sales referred to in Article 9(3) may be made in the case of a Consumer at the cash desk of the relevant Faculty no later than three months from the end of the month in which the Goods or Services were purchased.

11. A customer purchasing an admission or event ticket through a ticket machine receives:

        1) the admission or event ticket;

        2) a payment receipt;

        3) a fiscal receipt if the ticket vending machine is equipped with a sales recording device.

12. The University stipulates that an invoice may be issued for non-fiscal sales made through the ticket vending machine. In such a case, at the Customer's request, the University shall issue an invoice after the Customer has presented, at the cash point of the Unit concerned, a document confirming the purchase of a specific Service in a ticket machine belonging to the Facility concerned.

13. The purchased admission or event ticket shall be subject to inspection at the entrance by presenting it on paper or on an electronic device together with the document entitling to a concession or discount.

14. The purchase of an admission or an event ticket a stationary cash desk of the respective Facility, via a ticket vending machine or via the Online Sales Service is possible in advance, however, each Unit has its own ticket availability policy.

 

Article 4

Entitlement to concessions and discounts on ticket purchases

 

1. The following persons are entitled to purchase reduced admission tickets:

        1) school students, graduate and postgraduate students, including citizens of the Member States of the European Union;

        2) pensioners, persons over 65 years of age, including citizens of the Member States of the European Union;

        3) persons decorated with the Award For Protection of Historical Monuments, the Merited Cultural Worker honorary badge, For Merits for Polish Culture honorary badge, or distinguished by the honorary title For Merits for the National Culture;

        4) veterans;

        5) ISIC and ITIC card holders;

2. The following persons are entitled to purchase dedicated free tickets:

        1) donors and creators of collections at Facilities;

        2) people decorated with the Order of the White Eagle, the War Order of Virtuti Militari, the Order of Merit of the Republic of Poland, the Medal for Merit of Culture Gloria Artis;

        3) employees in museums listed in the National Museum Register (including the JU Museum);

        4) members of the International Council of Museums (ICOM) or the International Council on Monuments and Sites (ICOMOS);

        5) holders of the Polish Charter;

        6) children under the age of 4 (except children in organised groups);

        7) minors under the age of 16 with adjudicated disabilities and their guardians;

        8) persons with adjudicated I disability class equivalent to significant disability degree and their guardians;

        9) persons with adjudicated II disability class equivalent to significant disability degree and their guardians;

       10) persons with adjudicated III disability class equivalent to significant disability degree and their guardians;

3. The University stipulates that, depending on the decision of the manager of the given Facility, admission to an Event may not be subject to the concessions listed in paragraph 1.

4. The manager of the given Facility, in special cases compatible with the statutory activities of the University, may decide to grant a dedicated ticket free of charge to persons other than those indicated in paragraph 2, based on a written request of the Customer containing substantive justification. The list of the aforementioned cases shall be included in the annual report on the activities of the Unit.

5. Participants of national or regional cyclical events of an educational and cultural nature, in particular the Night of Museums and the Night of Scientists, are entitled to receive dedicated paid tickets.

6. The manager of the given Facility, in special cases compatible with the statutory activities of the University, may decide to grant a dedicated paid ticket to persons other than those indicated in Paragraph 4 based on a written application of the Customer to the manager of the Facility containing substantive justification, with the exception of JU employees and entities in which the University holds shares. A list of the aforementioned cases is to be included in the Unit's annual activity report.

7. The manager of the Facility is entitled to establish up to a maximum of four open days per calendar year for JU graduate and postgraduate students, and employees.

8. The proof of entitlement of persons to purchase a reduced admission ticket or a free dedicated ticket shall be:

         1) an appropriate card;

         2) an appropriate membership card;

         3) proof of age.

 

Article 5

Goods

1. All objects of intellectual property listed on the Online Sales Service, including works and trademarks, are the property of the University or the University uses them on the basis of its effective rights (including but not limited to licences and authorisations). Their use by the Customer beyond the normal use of the Online Sales Service (viewing the contents of the Online Sales Service and making purchases) without the prior written consent of the University is prohibited and is subject to liability for damages and criminal penalties.

2. The goods available in the Online Sales Service are brand new, legally introduced into the Polish market, and free from physical or legal defects.

3. The quantity of goods available in the Online Sales Service is variable and subject to constant updating. The University reserves the possibility of temporary unavailability of goods in the colours, sizes, language versions, quantities etc. requested by the Customer. Information about temporary unavailability of goods will be made available in the Online Sales Service.

4. The Goods shown in the images presented in the Online Sales Service may differ slightly in appearance from the original, in particular:

       1) the photos of the Goods may differ in colour from the actual colours of the Goods due to the different configuration of the electronic devices used by the University and the Customer;

       2) the photographs represent the design of the Goods offered for sale, in particular in the case of plant sales.

 

Purchase of Goods and Services in the Online Sales Service — general provisions

1. The University, to the maximum extent permitted by generally applicable legislation, is not responsible for force majeure events, interruptions in the operation of the online sales service resulting from the failure, unavailability and malfunction of ICT systems which are beyond the control of the University, incompatibility of the Online Sales Service with the Customer's technical infrastructure or actions of third parties.

2. The University shall be entitled to discontinue the sale of Goods or the provision of the Services set out in the Terms of Service in the event that:

        1) this is the consequence of a decision/recommendation of an authorised body on the basis of generally applicable legislation;

        2) the Customer violates the provisions of the Terms of Service in spite of being called upon by the University to cease the violations within the time limit indicated in the summons — with respect to a given Customer;

        3) it is necessary due to the security of the ICT system or maintenance of this system (including for the purpose of restoring its stability and security), its modernisation or expansion.

3. In the case referred to in paragraph 2(3) and in the event of a breakdown, the University shall also be entitled to suspend or restrict the sale of Goods or Services and the operation of the Online Sales Service.

4. The University shall use the Online Sales Service to inform Users of the circumstances indicated in paragraph I or 2 the Online Sales Service.

5. When using the Internet sales service and its functionalities, the customer undertakes:

         1) not to place on the Online Sales Service unlawful content, commonly regarded as vulgar and offensive, containing pornography, eroticism, obscene scenes, offending the feelings of others, including religious feelings, inciting violence, racist material, violating the right to privacy, infringing the personal rights of third parties, containing material protected by the rights of other entities without the consent of these entitled entities;

         2) not to use the online sales service in a way that disturbs its proper functioning and in a way that infringes the reasonable interests and personal rights of third parties and the University;

         3) not to interfere with the elements of the online sales service, its content and technical elements;

         4) use the online sales service in a manner that does not inconvenience other Customers;

         5) use the content of the online sales service for their own personal use, in accordance with section 1(6) of the Terms of Service.

6. Any interference with the online sales service, in particular with its functions or structure, is prohibited under penalty of liability for damages and, in the case of criminal interference, also under penalty of criminal liability.

7. When filling in the registration forms, using the online sales service and its functionalities, the Customer undertakes to provide data, including personal data, in accordance with the actual state of affairs. The University is not responsible for the consequences of false or incorrect information provided by the Customer. Responsibility in this respect, including for the legal consequences of actions taken in this way, rests with the Customer.

8. The Customer acknowledges that due to the nature of the Internet, the use of online services is associated with a risk of obtaining their personal data by unauthorised entities, and in order to minimise the risk of such a breach and limit the risks associated with the use of online services, they should apply the generally accepted principles of caution in this regard, technical measures to minimise these risks, including, for example, anti-virus software. For this reason, it is also particularly important to keep the access data to the Customer Account confidential.

9. In the event that the Customer receives any correspondence stating that the account for payment has changed or requesting that a traditional transfer be made to details other than those indicated in the Terms of Service, such payment should not be made. The Customer in such a situation is requested to contact the University using the details indicated in the Terms of Service and pass on the message addressed to them.

 

Purchase of Goods and Services in the Online Sales Service — Customer Account

 

1. The User purchases Goods and Services from the Online Sales Service by means of:

          1) an individual Customer Account;

          2) without registration, after providing the data necessary to complete the transaction (order) in terms of:

                a) first and last name,

                b) email address,

                c) postal address as the place of delivery of the purchased Goods,

                d) the Customer's address of residence or registered office, the Customer's tax identification number in the event of a request for a subsequent invoice in accordance with Article 10 of the Terms and Conditions.

2. In order to create a Customer Account, it is necessary to fulfil the following conditions:

           1) filling in the registration form available at https ://bilety.uj.edu.pl/uzytkownik/rejestracja.html;

           2) providing the first and last name;

           3) providing e-mail address to be used as the User's login (identifier);

           4) providing a mobile phone number which will ensure contact with the Customer;

           5) creating a password;

           6) accepting the provisions of these Terms and Conditions.

3. Upon fulfilment of the conditions referred to in article 2, the Customer shall receive a message sent at the e-mail address provided during registration confirming the registration of the Customer Account. In order to complete the registration of a Customer Account it is necessary to confirm the registration in accordance with the instructions contained in the e-mail.

4. Registration of a Customer for the purpose of creating a Customer Account is free of charge and voluntary. Registration takes place once. Subsequent transactions (orders) can be made within the framework of the created Customer Account on the basis of the previously established login and password.

5. The Customer shall gain access to their individual account via a login (user ID) and password.

6. The login and password are confidential. The Customer is obliged not to disclose them to third parties and is liable for damages caused by failure to comply with this provision.

7. Any changes to the Customer Account can be made by the Customer via the "My Account" tab available after logging in. The Customer is obliged to update the data within the Customer Account each time a change occurs. The Customer shall be liable for failure to update the data.

8. The moment the Customer Account is confirmed, in accordance with the procedure specified in paragraph 3, between the Customer and the University, an agreement for the provision of the service referred to in Article 1(7) of the Terms of Service is concluded under the conditions specified in these Terms and the Customer is given access to their individual Account.

9. A customer account is valid indefinitely. After logging in, the Customer may delete the Customer Account by selecting the option "Delete account" under "My account". Upon deletion of the account, the agreement referred to in paragraph 8 shall be terminated.

10. In the event of a loss of the password to access the Customer Account, the Customer may regain the ability to log in to the Customer's Account using their e-mail address provided in the registration form. To this end, he shall use the "Forgot password" option available at login to the Customer Account and follow the instructions.

11. The University shall be entitled to block the Customer Account if the Customer's actions and use of the Online Sales Service violate generally applicable laws, third party rights protected by law, legally protected secrets, principles of social coexistence, or the provisions of these Terms of Service. Prior to blocking the Customer Account, the Customer shall be summoned to cease violations. The summons shall be sent to the Customer's e-mail address. If the Customer does not cease the activities prohibited by the Regulations within the period indicated in the summons, the University shall be entitled to block the Customer Account immediately. The blocking of the Customer Account shall mean the termination of the agreement for the provision of electronic services with the Customer due to the fault of the Customer, as well as the taking of legal action as provided for by generally applicable laws.

 

Purchase of Goods and Services in the Online Sales Service — technical requirements

 

 1. In order to use the Online sales system, in particular to view the available Goods and Services, to place orders and to set up and use an individual Customer Account, it is necessary to meet the following technical requirements:

           1) having at one's disposal a PC or a mobile device;

           2) having access to the Internet;

           3) having installed in the system of the computer or mobile device the current version of the Internet browser (e.g. Mozilla Firefox version at least 60.0, Opera version at least 420, Google Chrome version at least 70.0, Microsoft Edge) and software for opening PDF files;

           4) enabling in the web browser the support, including the recording of cookies necessary for the functioning of the Online sales system;

           5) the Customer having an electronic address.

2. The University shall not be responsible for the Customer's failure to meet the technical requirements necessary to use the Online sales system and shall not be liable for any unsuccessful attempts to use or communicate with the Online sales system for these reasons.

3. Online sales of Goods and Services shall be conducted 7 days a week, 24 hours a day, except in the circumstances referred to in paragraph 4.

4. The University, to the maximum extent permitted by the applicable legislation, shall not be liable in the event of the circumstances referred to in Article 6(1), or in the event of necessary maintenance breaks necessary to ensure the proper functioning of the Online sales system.

5. The University shall not take responsibility for the blocking by email server administrators of the transmission of messages to the email address indicated by the User of the Online sales system and for the deletion and blocking of emails by software installed on the computer used by the User.

6. The University shall not take responsibility for errors occurring when the User accesses the Online sales system, resulting from incorrect data provided by the User.

7. The University shall not take responsibility for transactions carried out by unauthorised persons who have gained access to the Customer Account in the Online Sales Service as a result of a lack of care in the handling of the login and password to the account.

 

Purchase of Goods and Services in the Online Sales Service — placing online orders

 

1. Purchases of Goods and Services can be made in the Online Sales Service by placing an online order and making a payment.

2. The process of purchase of Goods and Services by the User through the Online Sales Service shall be in accordance with the messages and information presented to the User in the online sales service.

3. The duration of the provision of the Service to a User purchasing Goods or Services via the Online Sales Service depends on the type of Goods or Services in question.

4. Orders can be placed via the Customer Account after registration or without registration. To place an order without registration, it is necessary to have an e-mail address and a telephone number.

5. Viewing and purchasing the Goods or Services and their prices is possible without registration in the Online Sales Service.

6. In carrying out the activities referred to in paragraph 1, it is required to:

          1) make a selection of the Goods or Service in question by adding them to the Shopping Cart;

          2) in the event of the purchase of Goods, additionally indicate the method of delivery from among those made available by the University, indicate the delivery address if different from that indicated in the Customer Account (the one provided by the Customer during registration is indicated as the default delivery address);

          3) provide details for invoicing (optional) and select a form of payment from those made available by the electronic payment system accepted by the University;

          4) confirm the completion of the order (specific number, prices, delivery rules. and costs — as described) and the data necessary for its execution by using the "Order and pay" button;

          5) log in to the Customer Account, register in the Online Sales Service or choose the option to purchase without registration;

          6) accept the Terms of Service and the Information Clause by ticking the check box next to each of these consents.

7. The User of the Online Sales Service acknowledges that the User's selection of the "Pay online" button located at https://www.bilety.uj.edu.pl/ in the "Online payment" tab is tantamount to placing an order for the selected Goods or Services indicated therein, acceptance of the terms and conditions of the Sales Agreement for these Goods or Services to be concluded between the Customer and the University, and constitutes an obligation to pay the price of these Goods and Services, as well as any shipping costs selected by the User.

8. Until the order is confirmed by selecting the "Pay Online" button, the User may modify their order and its terms and conditions, including, but not limited to, the delivery address.

9. When making a purchase, the User is informed in the summary of the total amount to be paid, which includes the price of the selected Goods or Services, as well as any shipping costs.

10. After placing an order, the User shall receive an e-mail confirming acceptance of the order. The email message confirming the order includes a list of the Goods or Services ordered, their unit prices, the total price, as well as the delivery cost, if any, and the expected delivery time.

11. In the event of unavailability of the Goods or Services, the University shall make this known in the Online Sales Service next to the description of the Goods in question.

12. With regard to Users who are not Consumers, the University, to the fullest extent permissible under common law, shall not be liable for any delays in processing an order caused by circumstances beyond the control of the University.

13. The University shall not be liable for the consequences of the User placing an order incorrectly or contrary to the Terms of Service, including in particular orders contrary to the instructions presented on the Online Sales Service.

14. The agreement of sale of the selected Goods and Services shall be concluded upon making payment in one of the ways indicated in Article 10.15.

15. Orders placed on public holidays will be processed within the first working days following the day on which the order was placed.

16. At any stage of placing an order before payment has been made, the User may cancel the order by not taking any further steps to bring the order to completion. Such order shall be deemed cancelled and shall not be processed.

 

Article 10

Purchase of Goods and Services in the Online Sales Service — payment

 

1. Payment for the Goods or Services in the Online Sales Service is only possible by bank transfer or an electronic payment system accepted by the University on the website of the Online Sales Service available at https://bilety.uj.edu.pl.

2. Payment is made using the forms of payment available on the site of the electronic payment system, including online transfers, BLIK, Visa and MasterCard.

3. The rules of use of the service of the electronic payment system referred to in paragraph 2 are determined by this service, and the Customer, with regard to the choice of payment using this service, shall comply with the rules and regulations determined by the electronic payment system or the operator of this service.

4. The electronic payment system uses its own system of electronic notifications informing about the progress of payments, including when funds have been credited to the University's bank account.5. The Customer acknowledges and agrees to receive information about credits to the account in digital form only.

6. Payment is made when funds are credited to the University’s bank account. In the case of card payments, the completion date is calculated from the moment of positive authorisation of the transaction by the electronic payment system.

7. Once payment has been made, the University will send the Customer an electronic confirmation of the conclusion of the agreement of Sale. By accepting the Terms of Service, the Customer agrees to send the confirmation of the agreement of Sale in digital form.

8. The prices of the Goods and Services:

           1) are given in Polish zloty (PLN);

           2) include value added tax (VAT) at the rate applicable to the date of sale;

           3) the pricesgiven in the Online Sales Service are binding at the moment of purchase of the Goods or Services by the User, in accordance with the Price List for sales included in Appendix 1 to the Terms of Service.

9. Any additional costs connected with the purchase of Goods or Services over and above the prices specified in the Sales Price List shall require the separate and express consent of the Customer.

10. A Customer purchasing Goods or Services in the Online Selling Service receives:

            1) a pro forma invoice saved in a PDF file;

            2) a non-fiscal receipt or an invoice upon request made at the time of the purchase of the Goods or Services via the Online Sales Service or subsequent request made in accordance with paragraph 11, together with submission of the received proof of purchase at a stationary cash point of the Unit no later than within three months, counting from the end of the month in which the Goods or Services were purchased.

11. The request for an invoice for an earlier sale, referred to in paragraph 10(2), may take place in the case of a Consumer at the cash point of the Facility no later than within three months, counting from the end of the month in which the purchase of the Goods or Services took place.

12. When purchasing the Goods or Services via the Online Sales Service, the Customer agrees to receive electronic non-fiscal receipts or electronic invoices documenting the said sale saved in an electronic file in PDF format to the electronic address provided by the Customer.

 

Article 11

Purchase of Goods and Services in the Online Sales Service — order performance (prices and delivery of the Goods)

 

1. In the case of the purchase of Goods and Services, performance of the order by the University takes place directly after payment has been made by the Customer.

2. In the case of the purchase of Goods and Services, the lead time of the University is, as a rule, service working days from the date of payment within the meaning of Article 10, paragraph 6 of the Terms of Service, but in cases beyond the control of the University and not attributable to the University — but no longer than 30 calendar days. If the lead time is extended, the Customer will be informed of this at the e-mail address indicated during registration or when placing an order without registration. If the time limit indicated above is exceeded, the Customer has the right to withdraw from the Agreement without incurring any costs.

3. Following forms of delivery of ordered Goods Services are available:

           1) Services on the basis of issued tickets via e-mail in PDF format in the case of an admission ticket or Event ticket purchased via the Online Sales Service;

           2) Goods delivered by post or courier service — the cost of delivery is specified each time at the time of order configuration;

           3) Goods collected by a personal visit at the Facility, purchased through the Online Sales Service, after the University has credited the price for the Goods

4. The University may deliver the Goods to the Customer via an external delivery agent (postal operator, courier) specified when placing the order.

5. The cost of delivery or collection of the Goods shall be borne by the Customer unless otherwise specified by the University.

6. The University, postal operator or courier shall inform the Customer by e-mail that the parcel has been prepared and will then be posted to the address indicated by the Customer.

7. It is a condition for the Customer to collect the Goods in person by presenting the invoice sent via e-mail, after payment has been made in accordance with Article 10 of the Terms of Service, and signing the Goods Release Protocol with an employee of the Facility. The template of the Goods Release Protocol is set out in Appendix 6 to the Regulations.

8. The University shall, together with the Goods, provide the Customer with any documents available to the Customer relating to the Goods, such as the manufacturer's or distributor's warranty, the instructions for use or maintenance of the Goods, and the proof of purchase.

9. Before accepting the parcel from the deliverer, the customer is obliged to check whether the packaging has not been damaged in transit. If the packaging of the parcel bears signs of damage, the parcel should not be accepted. The Customer draw up a damage report in the presence of the deliverer and contact the University immediately to clarify the matter. The above procedure does not apply if the defect or damage to the parcel is discovered by the Customer after it has been delivered by the deliverer and it was not possible to notice the damage or defect from the outside upon receipt. In such a case, the deliverer shall ascertain the condition of the parcel at the request of the entitled person reported immediately after the discovery of the damage, but no later than within seven days from the date of collection of the parcel.

10. In the event that the order cannot be fulfilled, the University shall contact the Customer by e-mail at the previously indicated e-mail address and shall then immediately refund the Customer the money received from them.

 

Article 12

Right of withdrawal and return procedure

1. Pursuant to the provisions of Article 38(12) of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2020, item 287, as amended), the right of withdrawal from an agreement concluded off-premises or at a distance does not apply to consumers in respect of agreements for the provision of services related to leisure, entertainment, sports or cultural events, if the agreement specifies the day or period of service provision.

2. The Consumer shall have the right to withdraw from an agreement concluded at a distance without giving any reason within 14 calendar days from the date on which the Goods are taken into possession by the Consumer or an authorised/indicated third party, under the terms of the Consumer Rights Act of 30 May 2014. Notwithstanding this, together with the order confirmation and the Goods, the University shall send the Consumer an instruction on the possibility to withdraw from the Agreement. The instruction is attached as Appendix 2 to the Terms of Service.

3. The declaration of withdrawal from the Agreement may be submitted by the Consumer using the form "Declaration of withdrawal from the Agreement concluded at a distance" available at https://bilety.uj.edu.pl. The form is included in the Attachment No. 3 to the Terms of Service. The completed form shall be delivered by the Consumer to the University. The Consumer shall not be obliged to use the form, the declaration of withdrawal may also be made by omitting the form and in digital form. If the declaration of withdrawal is submitted electronically, the University shall confirm its receipt also electronically by sending a return e-mail to the Consumer.

4. In the case of withdrawal from an Agreement concluded at a distance, the Consumer is obliged to deliver the Goods to the registered office of the Unit concerned within 14 calendar days from the date of withdrawal from the Agreement. The shipping costs of the returned Goods shall be borne by the Consumer.

5. In the event that the Consumer submits a declaration of withdrawal from the agreement before the University has dispatched the Goods, the University shall not send the Goods to the Consumer and shall reimburse the Consumer for the order costs due.

6. There shall be no refunds for Goods or Services purchased through the Online Sales Service, except as indicated in the Terms of Service. Information about non-refundability is sent by e-mail to the e-mail address indicated by the User in the process of purchasing the Goods or Services.

7. In the event of cancellation of the Agreement, the University will reimburse the Consumer for the delivery (postage) and order costs incurred (price of the goods). The reimbursement of the shipping costs incurred by the Consumer will be made up to the amount of the cheapest form of delivery offered by the University, even if the Consumer has previously chosen another, more expensive form of delivery (including express delivery). Reimbursement of payment shall be made digitally.

8. Reimbursement of the cost of the order (the price of the Goods and the cost of shipping to the Consumer) shall be made within 14 calendar days of receipt by the University of the Consumer's statement of withdrawal from the Agreement. The University stipulates that in the case of a return relating to the sale of Goods evidenced by cash registers, it is necessary to draw up a Goods Return Protocol, a template of which is attached as Appendix 5 to the Terms of Service.

9. The University may withhold reimbursement of order costs received from the Consumer until the Goods are received back. The Consumer shall be liable for any diminution in the value of the Goods resulting from the use of the Goods beyond that which is necessary to ascertain their nature, characteristics and functioning, that is to say, inter alia, any damage to the Goods.

10. Customers purchasing a ticket at a ticket office, through a ticket machine or via the Online Sales Service are entitled to a 100% refund of the price of the Service not used in accordance with the ticket issued in the event of:

         1) closure of the Facility;

         2) the Facility's decision to completely stop the sale of Goods or Services for which an unused ticket has been purchased;

         3) the Unit changes the date of the purchased tour service in relation to the date indicated on the purchased ticket.

11. The reimbursement referred to in paragraph 10 shall be made in accordance with the following rules:

         1) The Customer shall send a request for the return of an unused ticket via the electronic mail available at address bilety.info@uj.edu.pl, specifying: name and surname, ticket number, date of sale of the Goods or Services confirmed by the issued ticket, booked date and time of the visit to the museum exhibition, bank account number to which the refund is to be made and the reason for the refund request;

         2) After positive verification of the refund request in accordance with these Terms of Service, a refund instruction is issued. If an invoice has been issued, the Customer shallreceive a correction invoice. Upon acceptance of the corrected invoice, the Customer will receive the refund due via the electronic payment system handling transactions made in the Internet sales system or by transfer to the Customer's bank account from which the payment transaction was made.

12. If it is necessary to refund a transaction made by the Customer with a payment card, the University will send back the funds to the bank account assigned to the payment card holder

13. In the case of an online transfer or BLIK transfer, the funds will be returned by the electronic payment system or directly by the University to the bank account number used to pay for the Goods or Services purchased via the Online Sales Service or a ticket machine.

14. In the event of withdrawal from a distance agreement, the agreement shall be deemed not to have been concluded.

15. The provisions of paragraphs 1-14 shall apply to a natural person concluding a agreement directly related to their business activity, where it is apparent from the content of that agreement that it does not have a professional character for that person arising in particular from the subject matter of their business activity made available on the basis of the provisions on the Central Register and Information on Business Activity.

 

Article 13

Complaint procedure

 

1. The Customer may report to the University, by way of complaint, the lack of or incomplete performance of the purchased Goods or Services, as well as any inadequacies in the Online Sales Service, a ticket vending machine or its functionalities, and failures in payment for the purchased Goods or Services using the electronic payment service, as well as any circumstances that may constitute non-performance or improper performance of the Agreement entered into by the parties at a distance in the manner indicated by the provisions hereof.

2. The complaint must be submitted in one of the ways chosen by the Customer:

           1) by e-mail to any of the e-mail addresses indicated in the Article 1(5) of the Terms of Service;

           2) in writing to the address of the Unit indicated in Article 1 Paragraph 5 of the Terms of Service, which has made a sale of the Goods or Services in return for payment by the Customer.

3. The complaint sent by the Customer shall indicate their name, electronic or postal address for contact, the number of the order being complained about, confirmation of payment, the name and surname of the holder of the bank account or payment card, the date of the transaction and the reason for the complaint, in particular the type and date of the irregularity related to the purchased Goods or Service.

4. The complaint shall be dealt with promptly, but no later than within 14 calendar days of delivery to the University. Once the complaint has been considered, a response will be sent to the Customer's e-mail address or, if it has been addressed to the Unit's registered office, by post to the sender's address or the indicated e-mail address in the correspondence.

5. Failure to notify the User of the manner in which the complaint has been resolved within the time limit indicated in paragraph 4 shall be deemed to be acknowledgement by the University (positive consideration).

6. A complaint regarding a malfunction of the electronic payment system should be submitted to the appropriate e-mail address of the electronic payment operator as stated in the content of its Service. If a complaint is made via the University, it is forwarded to the above-mentioned operator by the University for consideration. In the content of the complaint, the Customer is obliged to include: the reason for the complaint, a description of the objections, their e-mail address, the transaction identifier, the amount of the payment, the name and surname of the bank account holder, the date of payment and the name of the bank, the number of the bank account from which the payment was directed to the University.

 

Article 14

Defective goods

 

1. The University is liable for defects in Goods on the basis of the Polish Civil Code.

2. With regard to Customers who are not Consumers, the University's liability under warranty is excluded to the maximum extent permitted by the applicable legislation.

3. In the event that the purchased Goods are inconsistent with the Agreement (defective goods), the Customer may exercise their warranty rights on the principles laid down in the Polish Civil Code. If the Goods are covered by a manufacturer's or distributor's warranty, the Customer may exercise their warranty rights or the University's warranty at their own discretion.

4. In the event that the purchased Goods prove to be defective, the Customer may lodge a complaint using a complaint form, in which the defect(or defects) of the Goods should be described. The complaint form is included in Appendix 4 to the Regulations. The completed form may be sent on paper or by e-mail to the registered office address or e-mail address of the Unit whose defectiveness of the Goods is reported, as indicated in Article 1(5) of the Terms of Service. The Customer is not obliged to use the form. The complaint may be sent in any form, however, it should describe the noticed defect and specify the demands and, in the case of a Consumer, indicate whether they are pursued under warranty or guarantee.

5. Return of the Goods complained of, together with the proof of purchase, may take place after the Customer receives confirmation of acceptance of the complaint by the University and in a manner agreed with it. The University stipulates that in the case of a return relating to the sale of Goods evidenced by cash registers, it is necessary to draw up a Goods Return Record, a specimen of which is included in Appendix 5 to the Terms of Service.

6. The costs of delivery of the Goods complained of incurred by the Customer shall be reimbursed by the University in the manner agreed with the Customer and when a proof of such costs is produced.

7. The Customer who exercises the warranty rights to withdraw from the Agreement concluded at a distance or to return the Goods shall be obliged, at the expense of the University, to deliver the defective Goods to the place specified in the said Agreement and, if such place is not specified in the Agreement, to the place where the Goods were delivered to the Customer.

8. The provisions of Article 13 of the Terms of Service shall apply to the University's handling of complaints concerning defective Goods.

 

Article 15

The Newsletter

 

1. The Newsletter is a service that allows customers to receive information from the University about the current activities of the Facilities, promotional activities, discounts or new goods or services offered by the various Facilities.

2. The Newsletter is sent to the indicated e-mail address only to those Customers who, through the Online sales system, have given their express consent to receive the ordered commercial information within the meaning of Article 2(2) of the Act of 18 July 2002 on electronic service provision (i.e. Journal of Laws of 2020, item 344, as amended). The use of the Newsletter is voluntary.

3. The Customer may unsubscribe from the Newsletter at any time. To do so, they shall notify the University by email using the contact details indicated in Article 1(5) of the Terms of Service and in the Newsletter.

 

Article 16

Personal data protection

 

1. The controller of your personal data is the Jagiellonian University, 24 Gołębia Street, 31-007 Kraków.

2. A Data Protection Inspector has been appointed at the Jagiellonian University, Office of the Personal Data Inspector, 4/27 Czapskich Street, 31-110 Kraków. Contact with the Inspector is provided by e-mail: iod@uj.edu.pl or at telephone number 12 663 12 25.

3. Your personal data will be processed for the purposes of:

          1) the performance of the Agreement, the subject of which is the purchase of goods — Article 6(I)(B) RODO;

          2) the performance of legal obligations incumbent on the Data Controller in relation to the concluded Agreement — Article 6(1)(C) RODO;

          3) fulfilment of the Administrator's legitimate interest in the form of the assertion of possible claims or defence against claims related to the Agreement — Article 6(1)(F) RODO.

4. The provision of your personal data is a condition for the conclusion and performance of the aforementioned Agreement and the fulfilment of the Administrator's legal obligations. The consequence of failing to provide personal data will be the inability to conclude and perform the Agreement.

5. The collected personal data may be made available to public institutions and bodies authorised to process personal data on the basis of generally applicable laws and to entities processing personal data on behalf of the Administrator in connection with the performance of the task entrusted to them.

6. Personal data collected regarding:

(l) forename; (2) surname; (3) e-mail address will be made available to a separate data controller — the entity which is the operator of the electronic payment system, in order to perform the Agreement referred to in Paragraph 3 and to make the payment.

7. Your personal data shall be processed for the period necessary for the performance of the Agreement, including the execution of mutual settlements, for the period necessary for the establishment and assertion of your own claims or the defence against claims made.

8. You have the right to: to be informed about the processing of your personal data and your rights under the RODO, to have access to the content of your data and to have it rectified, and to have your personal data deleted from the Administrator's files, unless further processing is necessary for the performance of a legal obligation or for the establishment, investigation or defence of claims, and to have the right to restrict processing, to data portability, to object to processing — in the cases and under the conditions set out in the RODO.

9. Your personal data will not be subject to automated decision-making or profiling.

10. You have the right to lodge a complaint with the President of the Office for Personal Data Protection if you consider that the processing of your personal data violates the provisions of the General Regulation.

 

Article 17

Cookie policy

 

1. The Online Sales Service uses cookie files.

2. These files are stored on the customer's computer by the server of the Online Sales Service and provide statistical data about the customer's activities in order to tailor our offer to the customer's individual needs and interests.

3. The Online Sales Service software saves information in cookies relating to the following areas: session information, last viewed goods or services.

4. The customer may disable the option to accept cookies in their browser at any time, although they must be aware that in some cases the disconnection of these files may affect the use of the offer provided by the Online Sales Service.

 

Article 18

Amendments to the Terms of Service

 

1. The University may amend these Terms of service for valid reasons, including, but not limited to, changes in applicable legislation, changes or expansion of the profile of the Online Sales Service, changes to the scope and terms of sale of goods or provision of certain services, changes to the technical or technological conditions of sale of goods or provision of services, requirements related to cooperation with new subcontractors (partners) of the University or the intention to improve customer service.

2. Amendments to the Terms of Service shall not apply to Contracts concluded prior to the date of their modification, with the exception of amendments enforced by law and to Agreements concluded prior to the amendment, provided that information about the changes is sent to the electronic address at least 14 days prior to their coming into force, and the Customer does not, within this period, declare their intention to resign from further use of the services provided within the Online Sales Service. The Customer's failure to raise any comments or objections to the amendments to the Terms of Service within the aforementioned period shall be deemed to be acceptance of the new wording.

3. The amended Terms of Service shall be made available on the Online Sales Service website. The University shall inform of the amended Terms of Service by means of a message displayed on the Online Sales Service webpage and, in accordance with paragraph 3, by sending registered Customers an e-mail notification of the amended Terms of Service and providing a link to the amended Terms of Service or their updated content.

4. Exceptionally, the University may amend the Terms of Service with immediate effect under the following circumstances:

        1) such change is due to legislation or a decision issued against the University;

        2) the change is meant to protect Customers in connection with threats of crime, violation of personal data or integrity, and security of the Online Sales Service;

        3) the change is related to the introduction of new services provided through the Online Sales Service and does not affect the existing rights of Customers;

        4) the change concerns editorial elements which do not affect the rights and obligations of the Customers.

5. The University shall immediately inform Users of any change to these Terms of Service.

6. Orders placed before the amendments to the Terms of Service came into force shall be fulfilled in accordance with the existing content of the Terms of Service.
